Facts

Plaintiffs Casey Knox and Mercado Anima were employed as Service Technicians by defendant AN Imports of Stevens Creek, Inc. Plaintiffs filed a class action complaint against defendant for wage and hour violations.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiffs contended that defendant failed to compensate plaintiffs and other similarly situated workers the appropriate minimum wage rate thus violating wage and hour laws. Plaintiffs also contended that defendant failed to properly compensate plaintiffs for rest breaks in violation of Labor Code Section 226.7. Plaintiffs also contended that defendant failed to provide plaintiffs accurate itemized wage statements in violation of Labor Code Section 226(a). Lastly, plaintiffs contended that defendants failed to properly pay all wages due to plaintiffs at the time of the termination of their employment.

DEFENDANT'S CONTENTIONS: Defendant denied plaintiff's contentions.

Result

The court granted preliminary approval of the class settlement in the total amount of $3,501,000.
