Facts

Plaintiff Jon Hoffman was riding his bicycle at Diamond Street near 19th Street in San Francisco, California. At the same time, defendant Erika Walters was driving her vehicle, attempting to make a right hand turn when defendant collided with plaintiff. Plaintiff sued defendant for negligence.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff contended that defendant was negligent because defendant failed to use a right hand turn signal thus violating California Vehicle Code Section 22107-09.

DEFENDANT'S CONTENTIONS: Defendant denied plaintiff's contentions. Defendant contended that plaintiff failed to establish all elements necessary for a negligence cause of action.

Result

The court granted summary judgment in favor of defendant.
