Facts

Plaintiffs Sony Interactive Entertainment LLC and Sony Interactive Entertainment Inc. filed suit and asserted causes of action for trademark infringement, dilution, and unfair competition under federal and California law, against Defendants Prizm Labs, Inc., Blok Party, Inc. and 8Hours Foundation. The suit involved Defendants allegedly using confusingly similar variations of Sony's famous PlayStation(r) and PlayStation Network trademarks. Plaintiff Sony Interactive Entertainment Inc. is the owner of the PlayStation mark, while Plaintiff Sony Interactive Entertainment LLC is the exclusive licensee of the trademark rights in the PlayStation mark. Plaintiffs sought to permanently enjoin Defendants from using their trademark.

Contentions

PLAINTIFFS' CONTENTIONS: Plaintiffs contended Defendants purposely used similar variations of Sony's famous PlayStation(r) and PlayStation Network trademarks to market Defendants' gaming console, "PlayTable," and video game-related services "PlayNetwork." Plaintiff contended Defendants use of the trademarks infringed and diluted the PlayStation mark, and infringed the PlayStation-formative marks.

DEFENDANTS' CONTENTIONS: Defendants denied the contentions.

Result

The court granted Sony's permanent injunction.
