Facts

Plaintiff Rena Wyman has a neurological disorder called dystonia. Because of her disability, plaintiff has to use a wheelchair in order to travel in public places. Defendant High Times Productions, Inc. hosted the High Times Cannabis Cup Festival in Northern California. Wanting to attend the festival, plaintiff contacted defendant regarding wheelchair disability accommodations, which defendant ignored. Plaintiff attended the festival on May 4 and 5, 2018 but did not have access to travel, bathrooms, viewing areas, and other vendor booths. Plaintiff sued defendant for the lack of disability accommodations.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff contended that defendant violated Title II and Title III of the Americans with Disabilities Act by failing to provide plaintiff equal access to defendant's services. Plaintiff contended that defendant violated Section 504 of the Rehabilitation Act of 1973 because it discriminated against plaintiff because of her disability by not providing plaintiff proper assistance and aids during the festival. Further, plaintiff contended that defendant violated the California Unruh Civil Rights Act and the California Disabled Persons Act by lacking disability accommodations.

DEFENDANT'S CONTENTIONS: Defendant denied plaintiff's contentions.

Result

The case settled for $95,000.
