Facts

Radomir Nikodijevic's vehicle was rear-ended by Holly Ohanessian's vehicle in Burbank, California. Nikodijevic sued Ohanessian following the collision for his claimed injuries.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff contended that defendant negligently operated her vehicle and caused the collision with plaintiff. Plaintiff's expert opined that plaintiff required a future total left knee replacement and adjacent level lumbar fusion surgery.

DEFENDANTS' CONTENTIONS: Defendant admitted liability but disputed the nature and extent of plaintiff's injuries.

Settlement Discussions

Plaintiff demanded $1 million, and $650,000 by way of CCP 998. Defendant made a CCP 998 offer for $75,000 and $100,000.

Damages

Plaintiff sought $3.5 million.

Injuries

Nikodijevic claimed injuries to his neck, left trapezius, lower back, left knee and left hip. He underwent multiple epidural steroid injections, a left knee arthroscopy, and a two-level lumbar fusion.

Result

The jury found in favor of plaintiff and awarded $46,750 in damages, which was composed of $24,740 for past medical costs, and $22,000 for past non-economic damages.

Other Information

Defendant's recoverable costs would have resulted in a monetary judgment against plaintiff, but the parties agreed to a mutual walkaway, with no judgment for either party, and a waiver of appeal.
