Facts

Plaintiffs Cheryl Kater and Suzie Kelly filed a class action lawsuit against Defendants Big Fish Games, Inc., Aristocrat Technologies Inc., Aristocrat Leisure Limited, and Churchill Downs Inc., alleging its operation of Big Fish Casino constituted an illegal online casino.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiffs contended Defendants' online game platform constituted illegal gambling due to the nature of the games. Plaintiffs contended through in-app purchases, consumers wagered real money on the games, which violated Washington gambling laws. Plaintiffs contended that defendants retained hundreds of millions of dollars in profits generated from their unlawful games of chance and should not be permitted to retain those ill-gotten profits.

DEFENDANTS' CONTENTIONS: Defendants denied Plaintiff's contentions and any wrongdoing.

Result

The parties agreed to settle for the amount of $155 million.
