Plaintiff Berj Parseghian filed suit against Defendant Torn & Glasser Inc., and alleged Proposition 65 violations in relation to defendant's products.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff contended Defendant's vegetable chips contained lead, which is known in the state of California to cause cancer, birth defects, or other reproductive harm. Plaintiff contended Defendant knew customers consumed lead without giving clear and reasonable warnings.

DEFENDANT'S CONTENTIONS: Defendant denied Plaintiff's contentions and any wrongdoing.

Result

The parties agreed to settle for the amount of $35,000 plus conditions and remedies that required Defendant to reformulate the products without such chemicals or provide clear and reasonable warnings.
