Amos Webb worked as an electrician from the 1960s to the 1980s. He was diagnosed with mesothelioma when he was 80 years old. Webb sued General Cable Corp. in relation to his alleged exposure to asbestos-containing products.
Contentions
PLAINTIFF'S CONTENTIONS: Plaintiff contended that during the time he worked as an electrician, he was exposed to asbestos-containing wire and cable and that his exposure to asbestos caused his cancer. He further contended that defendant failed to warn consumers of asbestos in its products and as a result was liable for the damages suffered as a result of the cancer diagnosis.
DEFENDANT'S CONTENTIONS: Defendant denied the contentions. Instead, defendant contended that there was no evidence that the particular Romex wiring plaintiff used contained asbestos.
Result
The jury determined that plaintiff's damages amounted to $28,435,964, and that 39 percent of fault was attributed to defendant. The parties stipulated that $343,226.57 would be allocated to plaintiff as medical costs and $592,737 as non-medical economic damages.
