Facts

Plaintiffs Nequasha Potts and Marquis Berry were formerly employed by defendants Dolls Kill, Inc. and Trinet Group, Inc. Plaintiffs filed a class action lawsuit against defendants alleging various wage and hour labor code violations.

Contentions

PLAINTIFFS' CONTENTIONS: Plaintiffs contended that defendants failed to pay plaintiffs overtime wages for all overtime hours worked. Plaintiffs also contended that defendants failed to provide plaintiffs all requisite uninterrupted meal and rest periods to plaintiffs and other class members. Plaintiffs contended that defendants failed to compensate plaintiffs' minimum wages for all hours worked. Further, plaintiffs alleged that defendants failed to pay wages due upon termination of plaintiffs' employment. Plaintiffs also contended that defendants failed to reimburse plaintiff for necessary business expenses and related costs and failed to properly provide plaintiffs accurate wage and hour statements.

DEFENDANTS' CONTENTIONS: Defendants denied plaintiffs' contentions.

Result

The court preliminary approved the class action settlement. According to the terms of the settlement agreement, defendant agreed to pay a gross settlement amount of $400,000. $75,000 of the gross settlement amount has been allocated toward penalties under PAGA, of which $56,6250 will be distributed to the Labor and Workforce Development Agency. The net settlement of $18,750 will be allocated for distribution to participating class members.
