Contentions
PLAINTIFF'S CONTENTIONS: Plaintiff contended that defendant implemented systemic illegal employment practices that violated various labor code sections. Defendant intentionally prevented employees from taking meal periods and rest breaks as required by law. Moreover, defendants failed to properly calculate plaintiff's minimum wage and over time wages for their wage statements. Defendants also failed to provide plaintiffs with proper reimbursements and timely wage payments upon termination.
DEFENDANT'S CONTENTIONS: Defendants denied the contentions.
Result
The court approved a $175,000 PAGA settlement between the parties. The court allocated $86,224.64 of the gross settlement amount to fees and costs, individual settlement payments, and administrative costs.
