Plaintiff Ecological Rights Foundation filed suit against Defendant Monoprice Inc., alleging defendant violated Proposition 65.
Contentions
PLAINTIFF'S CONTENTIONS: Plaintiff contended Defendant knowingly and intentionally exposed consumers to Styrene, when consumers used filaments to operate 3d printers or 3d pens, that incorporated a styrene monomer and acrylonitrile-butadiene styrene filaments. Specifically, Plaintiff contended Defendant distributed, marketed, and sold 3d printers or 3d pens, that when heated in operation, released significant amounts of Styrene into the environment. Plaintiff contended Styrene caused cancer and other reproductive harm, but Defendant unreasonably failed to inform its customers or place warning labels on such products.
DEFENDANT'S CONTENTIONS: Defendant denied Plaintiff's contentions.
Result
The case settled for $70,000 and Defendant was required to place warnings on covered products, provide online warnings, notice and warning labels to downstream distributors, customers, retailers.
