Facts
Luis Angel Garcia Valencia was driving Eastbound on JFK Drive in San Francisco at the same time that officer Michael Callahan was en route responding to an emergency call. The two vehicles collided and Valencia sued the City and County of San Francisco as well as officer Callahan for the damage to his vehicle and his alleged injuries.
Contentions
PLAINTIFF'S CONTENTIONS: Plaintiff contended that the officer's negligence caused the collision that injured plaintiff. Since the officer was working at the time the collision occurred, the City and County of San Francisco were also liable for the collision and subsequent injuries to plaintiff. As a result, plaintiff contended that defendants were liable for the injuries that resulted from the collision.
DEFENDANTS' CONTENTIONS: Defendants denied the contentions but agreed to settle the claims against them in lieu of further litigation.
Result
The parties entered a $41,000 settlement agreement.
