Facts

Plaintiff joined the Nipomo High School girls' wrestling team in 2016 when she was 14 years old. She later filed a lawsuit against the wrestling coach, Justin Magdaleno, the high school, and the Lucia Mar Unified School District, alleging Magdaleno sexually assaulted and harassed her and other female minors and that the school district negligently hired, supervised, and retained him.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff contended that Magdaleno sexually assaulted and sexually harassed her and that she complained about his conduct to the principal of the high school. Plaintiff contended that Magdaleno then retaliated against her by encouraging students to harass her. Plaintiff contended that the school district continued to fail to remove Magdaleno as the head coach until 10 students came forward with allegations against Magdaleno in the fall of 2017. Plaintiff contended LMUSD allowed Magdaleno to retaliate against her and to resign while LMUSD allegedly agreed to not disclose any of the allegations against Magdaleno to any future prospective employer.

DEFENDANTS' CONTENTIONS: Defendants denied the contentions.

Injuries

Plaintiff alleged sexual assault, pain and suffering, emotional distress, harassment.

Result

The parties agreed to settle for $250,000 after two mediations.
