Facts

Plaintiff Robert Braver filed a class action lawsuit against Defendants Yodel Technologies, LLC and NorthStar Alarm Services, LLC, for alleged violations of the consumer-privacy provisions under the Telephone Consumer Protection Act.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff contended defendant Northstar violated the TCPA, when it hired a third-party, Yodel, who commissioned telemarketing calls to Plaintiff's and others telephone number for the purposes of advertising their goods and services, and further utilized a prerecorded message without express consent, which was prohibited by the TCPA. Additionally Plaintiff contended that he never consented to receiving such phone calls, thus defendants violated the TCPA.

DEFENDANTS' CONTENTIONS: Defendants denied Plaintiff's contentions and any wrongdoing.

Result

The parties agreed to settle. Northstar Alarms paid $1,850,000 and Yodel paid $1,750,000.
