Facts

On May 8, 2017, Los Angeles Police Department officers were responding to a home invasion call after a homeowner saw Anthony Soderberg inside their home asking for food. Police officers fired tear gas into the home to force Soderberg out. When Soderberg crawled out, gasping for air, unarmed, police shot him, including a shot from a SWAT officer who fired from a helicopter. Soderberg suffered several gun shots into his body, resulting in severe injuries which eventually caused his death.

Contentions

PLAINTIFFS' CONTENTIONS: Plaintiffs contended Defendants violated Soderberg's civil rights by using excessive force while acting under the color of law. As a result of using excessive force, Plaintiffs contended Defendants caused the wrongful death of Soderberg. Plaintiffs also contended Soderberg was deprived of due process.

DEFENDANTS' CONTENTIONS: Defendants denied all allegations and contentions. Defendants contended they were protected from liability under the doctrine of qualified immunity.

Result

The case settled for $1,150,000.
