Facts

Plaintiffs Marqus Martinez and Michaela Staggs brought a proposed class action against the Santa Rosa Police Department and the City of Santa Rosa, claiming they were seriously injured by tear gas and projectiles the Santa Rosa Police Department used on protestors during the Black Lives Matter protests in the summer of 2020.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiffs claimed that defendants violated their Fourth Amendment rights by using excessive force and their First Amendment rights by purposefully retaliating against them for engaging in constitutionally protected activity.

DEFENDANT'S CONTENTIONS: Defendants denied the contentions.

Result

The case reached a settlement of $1.9 million, including attorneys' fees, to plaintiffs.
