Facts
On May 12, 2018, Ciera Stoelting lost her baby in childbirth while in custody at Orange County jail. She then filed a wrongful death lawsuit against the County of Orange in federal court regarding the death of her baby.
Contentions
PLAINTIFF'S CONTENTIONS: Plaintiff contended that she asked jail staff to go to the hospital after having contractions but they did not let her, but instead watched her labor and deliver the baby while sitting on the toilet of her cell. She also claimed that her baby, Noah Stoelting, was born alive and then died due to county employees' failure to provide adequate medical care.
DEFENDANT'S CONTENTIONS: Defendant contended that Plaintiff suffered an intrauterine fetal demise (stillbirth) and that no amount of medical care could have saved the pregnancy. Defendant also contended that Stoelting never asked to go to the hospital, and that jail staff transferred Stoelting to a medical observation cell and was monitoring Stoelting's condition.
Result
The lawsuit settled for $1.5 million to Stoelting.
