Facts

Plaintiff Cristobal Velasquez alleged that he slipped and fell in the steam room at the Defendant LA Fitness International, LLC's fitness club and that Defendant's employees attempted to provide assistance after the incident but instead caused further injuries.

Plaintiff filed a lawsuit against Defendant for negligence and premises liability.

PLAINTIFF'S CONTENTIONS: Plaintiff contended that defendant's negligence caused plaintiff's injuries and that its employees caused further injuries.

DEFENDANT'S CONTENTIONS: Defendant moved for summary judgment on the grounds that no triable issue of fact exists where the express waiver of liability contained in Plaintiff's Membership Agreement is a complete bar to plaintiff's actions.
