Facts

Debbie Krommenhock and Stephen Hadley brought a class action against Post Foods LLC, alleging Post made misleading statements on the labels of various sizes and varieties of the following cereals: Honey Bunches of Oats, Great Grains, Raisin Bran, Bran Flakes, Honey Bunches of Oats Granola, Selects, Honeycomb, Shredded Wheat, Alpha-Bits, Waffle Crips, and Golden Crisp.

Contentions

PLAINTIFFS' CONTENTIONS: Plaintiffs contended defendant's statements on the Post Cereals suggest they are healthy, which is deceptive because they contain a high sugar content. Plaintiffs contended defendant misrepresented consumers because the health and wellness claims are untrue as the Post Cereals contain a high sugar content. Plaintiffs contended defendant exposes children to the dangers of excess added sugar in the Post Cereals. Plaintiff contended defendant violated Food and Drug Administration labeling regulations.

DEFENDANT'S CONTENTIONS: Defendant denied all of the contentions.

Result

The case settled for $15,000,000.
