Facts

Salvador Robles was riding his non-motorized Razer scooter northbound through an unmarked crosswalk on the West side of Hooper Avenue at the intersection of 58th Avenue. A County of Los Angeles Public Works truck collided into him. Plaintiff brought an action against the County as a result.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff contended defendant's employee caused the collision and violated California Vehicle Code Section 21950(a) which requires a vehicle to yield the right-of-way pedestrian crossing the roadway within any marked or unmarked crosswalk at an intersection.

DEFENDANT'S CONTENTIONS: Defendant denied all of the contentions. Defendant contended plaintiff may have violated Vehicle Code Section 29154(a) which requires pedestrians to yield the right-of-way to all vehicles other than in a marked or unmarked crosswalk at an intersection.

Result

The case settled for $370,000.
