Defendant Redmond Trading Company, LLC produced, manufactured, distributed, sold, and offered for sale, in or into California, a baby powder called Amazingly Natural Baby Powder. Center for Advanced Public Awareness brought a lawsuit against defendant alleging defendant violated Proposition 65.
Contentions
PLAINTIFF'S CONTENTIONS: Plaintiff contended defendant exposed consumers, especially infants, to lead, which is known to the State of California to cause cancer, or reproductive harm. Plaintiff contended defendant violated Proposition 65 when defendant failed to provide clear and reasonable warnings that the subject products contained lead. Plaintiff contended defendant knew or should have known that the subject products contained lead.
DEFENDANT'S CONTENTIONS: Defendant denied all of the contentions.
Result
The case settled for $55,000. Defendant is required to provide clear and reasonable warnings on the subject products. Defendant is required to provide warnings labels for its own website or third-party websites that sell the subject products on the internet.
