Facts

On June 29, 2018, Armin Abdollahvan, was involved in a rear-end auto collision with Todd Andrews, an employee for the Department of Recreation & Parks with the City of San Francisco. He filed suit against the City and County of San Francisco, the Department of Recreation & Parks and Todd Andrews.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff alleged personal injury and loss of wages and use of property, hospital and medical expenses, general and property damages and a loss of his earning capacity and requested compensatory damages due to the collision with Todd Andrews.

DEFENDANT'S CONTENTIONS: Defendant denied all allegations and alleged that Plaintiff's negligence contributed to and was a proximate cause of his own injuries, or was the sole cause of those injuries. Defendant also stated that Plaintiff had full knowledge of and voluntarily assumed all risks. Furthermore, Plaintiff's carelessness in conduct and manner closely contributed to his injuries and damages barring his claims and Plaintiff failed to use reasonable diligence to mitigate damages.

Injuries

Plaintiff's alleged injuries included a mild traumatic brain injury, associated headaches and memory issues, as well as injuries to the lumbar spine.

Result

The City settled the lawsuit for $50,000.
