Facts
Jimmy Banh, one of several Plaintiffs, bought a new 2019 or 2020 Acura RDX from an authorized Acura dealer in California. Plaintiffs filed a class action lawsuit against Defendant, American Honda Motor Co. Inc., alleging they experienced different problems with their new vehicles' infotainment system. This system is designed to attract buyers who want to manage available technology while on the road as to minimize distractions while maximizing safety. Aspects of the infotainment system included the navigation system, audio system, backup camera, Bluetooth and Apple CarPlay. Plaintiffs further alleged Defendant never found a solution but instead relied on notifying owners that a forthcoming software update was in the works.
Contentions
PLAINTIFF'S CONTENTIONS: Plaintiffs alleged, among other things, that Defendant's infotainment systems in their 2019 and 2020 Acura RDX contained one or more defective components. Because of the alleged defects, plaintiffs claimed the infotainment system frequently crashed, froze or worse, rendered many of the cars' features inoperable which posed a safety risk. The defect could also cause safety-related systems, such as the backup camera, to fail.
DEFENDANT'S CONTENTIONS: Defendant denied all contentions.
Result
The case settled. Class Members may file a claim seeking reimbursement for certain out-of-pocket battery-recharging costs and are eligible to file a claim for reimbursement for qualifying transportation costs. Honda has also agreed to extend the New Vehicle Limited Warranty adding two years or 24,000 miles to cover certain Acura Infotainment System symptoms. Honda agreed to implement a "Dealership Assessment and Assistance Program" and create, maintain, and update, an Infotainment System Online Resource for class members.
