Facts
Plaintiff John Anderson was lawfully driving his truck when he was t-boned by another truck driver Raymond Carreon who was in the course and scope of his employment with defendant R&R Transportation. Plaintiff eventually underwent a two-level cervical fusion.
Contentions
PLAINTIFF'S CONTENTIONS: Plaintiff contended that defendant was 100 percent at fault for the collision.
DEFENDANT'S CONTENTIONS: Defendant admitted liability, but contended in part that plaintiff's injuries were pre-existing, as evidenced by the fact that plaintiff received an epidural steroid injection to his neck just two months before the incident.
Settlement Discussions
Plaintiff served a C.C.P. 998 offer for $2 million. Shortly after, the parties agreed to a settlement in that amount.
