Plaintiff Prince Gerard Mahboubain was riding his motorcycle in the northbound lane of Topanga Canyon Boulevard. Defendant Akis Kourtzidis was driving in the southbound lane. Kourtzidis was driving an SUV for Defendant All Decade Team Enterprises LLC, a car service that transports passengers.
Contentions
PLAINTIFF'S CONTENTIONS: Plaintiff contended that Defendant negligently operated his vehicle in such a manner as to cause a head-on collision between the parties.
DEFENDANTS' CONTENTIONS: Defendant contended that Plaintiff did not and cannot show a breach of duty. Defendants noted that passengers in the vehicle, witnesses to the collision, and the lead investigator testified or concluded that Plaintiff crossed the double-yellow lines into Defendant's lane, apparently in an attempt to pass another vehicle in his own lane. Defendants also hired an expert accident reconstructionist, who reviewed the Traffic Collision Report, photographs, analyzed the vehicles and investigated the scene and concluded that Plaintiff caused the collision.
Result
Plaintiff submitted no evidence to support his claims. Defendants Kourtzidis and All Decade Team Enterprises, LLC.'s Motion for Summary Judgment was granted.
