Facts

On May 13, 2017, 51-year-old Sheila Carr was driving north on Calistoga Road, in Santa Rosa, California. When Carr was approximately 530 feet north of the intersection with Bodmer Lane, her vehicle was sideswiped by a vehicle that was heading southbound and operated by Johann Jaramillo. Carr brought an action against Jaramillo alleging that Jaramillo cause the accident by negligently operating his vehicle and, as a result, caused Carr injuries to her head, chest, and left wrist.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff contended defendant caused the accident because defendant was negligent in the operation of his vehicle. More specifically, plaintiff contended that defendant caused the accident when defendant took an evasive maneuver to avoid a rock in the roadway. The evasive maneuver caused defendant to steer to the right, causing the right side of his vehicle to strike the rock-covered hillside to the west of the roadway. After striking the hillside, defendant steered back to the left and drifted over the double yellow lines, where defendant crashed into plaintiff's vehicle in the northbound lane. Plaintiff further contended that defendant caused the collision by making a negligent lane change. Plaintiff also contended defendant's negligent operation of his vehicle caused injuries to her head, chest, and left wrist.

DEFENDANT'S CONTENTIONS: Defendant denied all of the contentions. Defendant disputed plaintiff's version of the events and asserted he was not at fault for the crash. Defendant asserted that plaintiff was to blame for the crash.

Plaintiff suffered fractures to her arm, wrist, sternum, a communicated facture, and on her fingers. Plaintiff also suffered a closed head injury. Plaintiff claims that she needs on going treatment to her left wrist, including physical therapy.

The case settled for $1,000,000 prior to trial.
