The Sanrio Company owns the copyrights and trademarks with respect to its designs, products, and characters such as Hello Kitty. Sanrio brought an action against Scion Global Production and Rick Pan alleging that defendants made unauthorized uses of Sanrio's property or had made substantially similar likeness or colorable imitations.
Contentions
PLAINTIFF'S CONTENTIONS: Plaintiff contended that defendants infringed on their copyright and trademarks. Plaintiff contended that defendant engaged in the unauthorized use of Sanrio's property or had made substantially similar likeness or colorable imitations
DEFENDANT'S CONTENTIONS: Defendant denied all of the contentions.
Result
The parties stipulated to a consent decree and permanent injunction. Plaintiff is entitled to recover $100,000 from defendants. Defendants are permanently enjoined from importing, manufacturing, distributing, advertising, selling, offering for sale products in connection to the likeness or bear a confusing similarity to any of plaintiff's properties. Defendants are also permanently enjoined using a false presentation to describe goods as being those owned by the plaintiff.
