Facts

Christina McGovern was walking near the corner of 8th Avenue and Balboa Street in the city of San Francisco when she tripped over an unmarked cement block and fell face first into the sidewalk. As a result of the fall, McGovern was seriously injured. McGovern sued the City and County of San Francisco under a theory of premises liability for her injuries.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff contended that defendants negligently owned, maintained, managed, and operated the described premises. Plaintiff asserted that defendants willfully or maliciously failed to guard or warn against the dangerous condition of the unmarked cement block on the sidewalk.

DEFENDANTS' CONTENTIONS: Defendants denied all contentions.

Damages

Plaintiff sought damages for loss of wages, loss of earning capacity, hospital and medical expenses, and other damages related to her injuries.

Result

The case settled for $100,000.
