Facts
Benigno Solis and his daughter, Scarlet Solis, were driving on State Route 138 on December 24, 2015. As they were passing through the intersection at Mountain Road in Pinon Hills, Reginald Williams made a left turn in front of Solis's minivan, and Solis's vehicle collided with the right side of Williams's vehicle. Benigno and Scarlet Solis filed suit against Williams. After the complaint was filed, Williams died, so his estate was substituted as defendant.
Contentions
PLAINTIFFS' CONTENTIONS: Plaintiffs contended that Williams operated his vehicle in a negligent manner; and that his negligence was a direct and proximate cause of their injuries.
DEFENDANT'S CONTENTIONS: Counsel for the defendant conceded liability at trial, but contended that Plaintiffs' medical treatments were unnecessary and unreasonable.
Damages
Benigno Solis incurred medical expenses of roughly $101,818. Scarlet Solis incurred medical expenses totaling roughly $3,420. Both plaintiffs also sought damages for past pain and suffering.
Injuries
Benigno Solis suffered a nose fracture and septum injuries, and underwent surgical reconstruction. He also sustained back and neck injuries. Scarlet Solis also suffered neck and back injuries requiring medical treatment.
Result
At trial, the jury determined Defendant had been negligent, and it awarded Plaintiffs $137,938 in damages. Plaintiff was also awarded $80,338.12 in costs as the prevailing party on a CCP 998 offer.
