Facts

On the morning of March 1, 2020, Rui Xia Zhen, a home healthcare worker, was walking in a marked crosswalk at the intersection of Geary Street and Taylor Street in San Francisco, California. As she was crossing the street, a San Francisco Department of Public Works truck driven by Ahjae Holdman made a left turn at the intersection and collided with Rui Xia Zhen. She suffered serious injuries to her head and face, and she was transported to the hospital where she later died. Rui Xia Zhen was 67 years old at the time of her death. Huan ZhengDang, Zhen's spouse, and Zhuorong Fang, Zhen's son, filed suit against the City and County of San Francisco.

Contentions

PLAINTIFFS' CONTENTIONS: Plaintiffs contended that Holdman's negligence caused Rui Xia Zhen's death; that Holdman was an agent and employee of the City and County of San Francisco and the Department of Public Works when the accident occurred; that he was acting within the scope of his employment when the accident occurred; and that the City and County and the Department of Public Works were liable for his negligent acts and for the wrongful death of Rui Xia Zhen.

DEFENDANTS' CONTENTIONS: Defendants denied any wrongdoing and all of Plaintiffs' material allegations. Defendants further contended that the suit was barred by governmental immunity.

Result

The parties reached an agreement wherein the City and County of San Francisco will pay $2 million to settle plaintiffs' claims.
