Facts
City of San Diego police officers were responding to a domestic violence call when they apprehended Eric Ball. Ball was taken into custody and transported to the San Diego County Jail. Subsequently, Ball filed an action against the City of San Diego.
Contentions
PLAINTIFF'S CONTENTIONS: Plaintiff contended that he suffered significant facial injuries when defendant's police officers arrested plaintiff in his home while responding to a domestic violence call. Plaintiff claimed that, after being taken to county jail in handcuffs, plaintiff was pushed down by an officer, causing him to fall and suffer multiple broken bones in his face when he hit the ground.
DEFENDANT'S CONTENTIONS: Defendant denied all contentions.
Injuries
Plaintiff sustained fractures of the sinus wall, multiple displaced bilateral nasal bone fractures, and multiple fractures of the jaw requiring the jaw to be wired shut and supported with several screws. Plaintiff's injuries required a five-day stay at UC San Diego Medical Center. Plaintiff required surgery to implant a metal plate and screws in his face.
Result
The case settled for $775,000.
