Facts

Rentokil North America, Inc. offers pest control solutions and a wide range of other beneficial services, including disinfection, for commercial businesses across the United States. Patrick Dotan brought a class action and pursued a Private Attorneys General Act action against Rentokil on behalf of all California citizens currently or formerly employed by Rentokil as non-exempt employees during the class period.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff asserted claims for failure to pay minimum wages; failure to pay overtime wages and commissions; failure to provide meal periods; failure to permit rest breaks; failure to provide accurate itemized wage statements; failure to pay all wages due upon separation of employment; and violation of the Business and Professions Code. Plaintiff alleged that defendant had engaged in a systematic pattern of wage and hour violations under the California Labor Code and Industrial Welfare Commission Wage Orders, all of which contributed to defendant's deliberate unfair competition.

DEFENDANT'S CONTENTIONS: Defendant denied all contentions.

Result

The case settled for $3,600,000.
