Facts

Scott's Sacramento River Inc. is the parent company of Scott's on the River, a seafood restaurant attached to the Westin Sacramento. Dionysios Yuri Shallan brought a putative class and Private Attorneys General Act (PAGA) action on behalf of all current and former, non-exempt, banquet employees of Scott's Sacramento River who worked in California from March 24, 2016 to September 29, 2020.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff alleged that defendant engaged in wage and hour violations under the California Labor Code Section 2698 et seq. The allegations included, but were not limited to the following contentions: failure to pay minimum wage, straight time wages and overtime wages, unpaid premium pay for violations of California's meal period and rest break law, waiting time penalties, penalties for non-compliant wage statements and failure to keep accurate payroll records, and failure to reimburse employees for reasonably incurred business expenses, and failure to pay gratuities.

DEFENDANT'S CONTENTIONS: Defendant denied all contentions.

Result

Defendant agreed to pay an "all in" amount of $102,500 to fund the settlement. This total amount includes payment of all individual settlement payments to participating settlement class members, the class counsel award, settlement administration costs, the PAGA settlement and the class representative award to plaintiff.
