Facts

Global Building Services Inc. is a janitorial and facility maintenance company, providing janitorial services to commercial, industrial and retail establishments. Marissa Cardenas, a former employee of Global Building, seeking to represent a class of non-exempt individuals employed by Global Building during a certain class period, filed a class action complaint on December 4, 2018. On April 19, 2019, Cardenas amended her complaint to add a cause of action for civil penalties under the Private Attorneys General Act (PAGA).

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff, Cardenas, alleged that defendant violated certain wage and hour laws. Specifically, plaintiff contended that defendant failed to pay minimum wage and straight time wages in violation of Labor Code Sections 204, 1194, 1194.2, 1197; failed to pay overtime compensation in violation of Labor Code Sections 1194, 1198; failed to provide meal periods in violation of Labor Code Section 226.7; failed to indemnify business expenses in violation of Labor Code Section 2802; failed to timely pay final wages at termination in violation of Labor Code Sections 201 to 203; and, failed to provide accurate itemized wage statements in violation of Labor Code Section 226. She also asserted an unfair business practices cause of action under Business and Professions Code.

DEFENDANT'S CONTENTIONS: Defendant, Global Building, denied all material allegations asserted in the lawsuit.

Settlement Discussions

On January 6, 2021, the parties mediated before Steven Mehta, Esq., agreeing to the settlement's basic terms at that time.

Result

The court granted final approval of the settlement on January 26, 2022. The class settlement amount is $1.1 million.
