Facts

Good-West Rubber Corp., located in Rancho Cucamonga, provides rubber coating products. The company, offering a wide range of immersion-grade linings and protective coating products, serves several industries including water, power, oil, steel, chemical and mining. Ulisses Lopez was employed by Good-West Rubber as a non-exempt employee. On June 23, 2020, he filed suit in San Bernardino Superior Court against Good-West Rubber.

Contentions

PLAINTIFFS' CONTENTIONS: Plaintiff, Lopez, alleged class and representative claims against defendant, Good-West, for the following: failure to pay all overtime wages; minimum wage violations; rest period violations; meal period violations; wage statement violations; unfair competition; and civil penalties under the Labor Code Private Attorneys General Act (PAGA).

DEFENDANT'S CONTENTIONS: Defendant, Good-West, denied that it did anything wrong and believed that it acted in compliance with all applicable laws. It further argued that plaintiff, Lopez's, claims were without merit and denied that it owed any wages, restitution, penalties or other damages.

Result

Good-West agreed to pay a gross settlement amount of $800,000. A claim for waiting time penalties was also stipulated to as part of the settlement.
