Plaintiff Robert Lambing Jr., DDS. is a 55-year-old dentist who was practicing at a clinic in Burney. In the fall of 2020, he fell into a PG&E subsurface electrical vault and broke his right wrist. Following two surgeries his treating physician declared him permanently and totally disabled from the practice of dentistry.
Contentions
PLAINTIFF'S CONTENTIONS: Plaintiff contended that PG&E failed to properly inspect and maintain the subsurface electrical vault in violation of various CPUC standards. Plaintiff also contended that before his wrist injury he would have practiced General Dentistry until his retirement.
DEFENDANT'S CONTENTIONS: Defendant contended that it complied with all CPUC standards and adequately maintained the subsurface electrical vault; it was Dr. Lambing's and others' prohibited interference with the vault that caused the injury. PG&E also contended that Dr. Lambing's preexisting medical conditions materially shortened his dental career and substantially decreased his alleged economic loss.
