Glorianne Mendoza filed a class action against supermarket chain ALDI Inc. and AI California LLC, which is part of the business support services industry. The class included all persons in the United States who applied for employment with ALDI and were the subject of a consumer report that was procured by ALDI or caused to be procured by ALDI during the class period.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff contended that defendants failed to provide compliant background check disclosures/authorizations under the Fair Credit Reporting Act.

DEFENDANTS' CONTENTIONS: Defendants denied all contentions and contended that their background check policies and procedures and background check disclosures/authorizations were lawful and had been lawful during the class period. Defendants also contended that plaintiff's claims did not meet the requirements for class certification.

Result

The case settled for $4,500,000.
