Facts

Keith Pillow, Frank Chindamo and Megan Maixner filed a class action and pursued a Private Attorney General Act (PAGA) action against their former employer, Pepperdine University. The class included non-exempt part time instructors, including adjunct instructors, employed by Pepperdine University during the relevant period.

Contentions

PLAINTIFFS' CONTENTIONS: Plaintiffs contended that defendant failed to pay class members for all hours worked; failed to provide class members legally-compliant rest and meal breaks under California law; failed to pay all wages owed timely during employment and upon discharge from employment; and failed to furnish accurate wage statements, thereby engaging in unfair business practices and conduct that gave rise to penalties under PAGA.

DEFENDANT'S CONTENTIONS: Defendant denied all contentions and contended that plaintiffs' claims had no merit.

Settlement Discussions

The parties attended a full-day mediation with Lisa Klerman and reached an agreement on the basic terms of the settlement.

Damages

Plaintiffs sought, among other things, recovery of unpaid wages; meal and rest period premiums; restitution; penalties; interest; attorneys' fees and costs; and also claimed penalties under PAGA.

Result

The case settled for $940,000.
