Facts

On March 15, 2020, Leslie Drapkin was walking up the stairs at Webster Street and Broadway in the City of San Francisco when she stepped on a cracked and uneven stair that caused her to trip and fall. Drapkin subsequently sued the City and County of San Francisco and Panorama Apartments.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff contended that she sustained serious injuries as a result of a very dangerous and damaged stair. Plaintiff contended that defendants negligently owned, maintained, managed and operated the premises; willfully or maliciously failed to guard or warn against the dangerous condition; and that defendants had constructive notice of the existence of the dangerous condition in sufficient time prior to the injury to have corrected it.

DEFENDANTS' CONTENTIONS: Defendants denied all contentions. Defendants contended that plaintiff had full knowledge of the risk involved in the activity in which plaintiff was engaged at the time of the happening of the incident; plaintiff was negligent in and about the matters and activities set in the complaint; and plaintiff failed to exercise reasonable care and diligence to mitigate plaintiff's alleged damages.

Result

The case settled for $75,000.
