Plaintiff Jesse Garcia was a passenger in a Lyft vehicle traveling on the 405 freeway, which came to a stop and was rear ended by defendant David Walker, causing them to be pushed into the car in front.

DEFENDANT'S CONTENTIONS: Defendant looked at his cell phone to get directions to the game he was going to with his wife and daughter. He did not see the traffic in front of him slow and stop.
