Facts

Melvin George filed suit against his former employer, Total Professional Network Inc., an employment staffing agency that assigns health care professionals to work at health care facilities throughout California. The action was brought on behalf of all non-exempt employees working for Total Professional Network who were assigned to work at any healthcare facility inside California during the class period.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff asserted claims for failure to reimburse for business expenses; failure to pay for all hours worked; failure to pay overtime; failure to pay minimum wage; failure to authorize and/or permit rest breaks; failure to furnish accurate wage statements; waiting time penalties; unfair business practices; and Private Attorneys General Act penalties.

DEFENDANT'S CONTENTIONS: Defendant denied all contentions and contended that it fully complied with the California Labor Code and all other applicable state and federal laws and regulations.

Settlement Discussions

The parties participated in an all-day mediation presided over by Hon. Carl J. West (Ret.), which did not result in a settlement. The parties continued settlement negotiations and eventually accepted the mediator's settlement proposal and documented their agreement in the form of a Memorandum of Understanding.

Result

The case settled for $2,000,000.
