Facts

Senior citizen couple alleged that members of the Riverside Sheriff's Department performed warrantless searches of two homes in Lake Elsinore under the mistaken impression that the couple's low electricity consumption was indicative of power theft to grow marijuana. The plaintiffs also alleged the wife of the couple was improperly detained by sheriff's deputies. Neither the County of Riverside, nor the Riverside County Sheriff's Department, were named as defendants in the lawsuit. The only named defendant denied plaintiffs' claims in their entirety and denied liability

DEFENDANT'S CONTENTIONS: Defendant denied liability and settled only to avoid the estimated future costs associated with litigation.
