Facts

Trius Trucking Inc is a transportation company that provides dry and temperature controlled hauls. Augustus Mondrian worked for Trius from February 2016 through April 2016 as a truck driver. Rhonda Jones also worked for Trius from March 2016 to September 2016, also as a truck driver. On May 10, 2016, Mondrian filed a class action suit against Trius in Fresno Superior Court. Jones later joined in January 2017.

Contentions

PLAINTIFFS' CONTENTIONS: Plaintiffs' asserted that defendant violated California Labor Code, Business and Professions Code and federal Fair Labor Standards Act wage, hour, and other labor-related claims, also giving rise to penalties under California's Private Attorneys General Act claims. Plaintiff contended that he was paid piece-rate, not provided minimum wages for all non-production work time, and did not receive paid rest breaks nor legally required meal periods.

DEFENDANT'S CONTENTIONS: Defendant denied all contentions.

Result

The case settled for $995,000.
