Facts

Cheylyn Ross worked as an hourly, non-exempt customer service employee for Stater Bros. Markets, which is a San Bernadino-based California supermarket chain that operates throughout Southern California. On May 24, 2019, Ross filed a class action lawsuit in San Bernadino Superior Court against Stater Bros. on behalf of herself and on behalf of all others similarly situated.

Contentions

PLAINTIFFS' CONTENTIONS: Plaintiffs contended that the defendant failed to pay all wages owed, including overtime; the defendant failed to provide adequate rest breaks and meal periods; the defendant failed to timely pay employees wages due upon separation from employment; the defendant failed to reimburse employees of necessary business expenses; the defendant knowingly and intentionally failed to provide accurate, itemized wage statements; the defendant engaged in unfair competitive practices; and the defendant was liable for damages for these actions and under the Private Attorneys General Act.

DEFENDANT'S CONTENTIONS: Defendant denied any wrongdoing or liability and all of plaintiffs' material allegations.

Result

The parties reached an agreement wherein defendant admitted no wrongdoing but agreed to pay up to $6.15 million to settle class members' claims.
