Shana Wright worked as an hourly non-exempt employee of Winganomics, Inc. On February 7, 2020, Wright filed a class action complaint against Winganomics and Jason Kahn on behalf of herself and on behalf of all others similarly situated.
Contentions
PLAINTIFF'S CONTENTIONS: Plaintiff contended that the defendants had a consistent policy that encouraged, permitted, or required employees to work off the clock, and so they failed to pay employees for all hours worked; failed to compensate employees for missed meal periods and rest breaks; failed to timely pay wages due upon separation from employment; and failed to provide accurate itemized wage statements.
DEFENDANTS' CONTENTIONS: Defendants denied any wrongdoing or liability and all the plaintiff's material allegations.
Result
The parties reached a settlement agreement wherein the defendants admitted no wrongdoing or liability but agreed to pay $1.5 million to settle class members' claims.
