Facts

Augusta Financial, Inc. is a mortgage banker and mortgage broker that provides services across Southern California. Gina Davidson worked as a non-exempt, hourly employee of Augusta Financial. On July 17, 2020, Davidson filed suit against Augusta Financial and Michael J. Meena on behalf of herself and on behalf of all others similarly situated.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff contended that the defendants failed to pay all overtime wages due; to provide adequate meal periods or pay meal period premiums; to provide adequate rest breaks or pay rest period premiums; to pay minimum wage; to pay timely all wages due upon termination or separation from employment; to furnish accurate itemized wage statements; and to reimburse necessary business expenses incurred. Plaintiff also asserted various claims under the Private Attorneys General Act.

DEFENDANTS' CONTENTIONS: Defendants denied any liability or wrongdoing and all of the plaintiff's material allegations.

Settlement Discussions

The parties participated in a formal mediation session on February 4, 2021.

Result

The parties reached a settlement agreement wherein the defendants admitted no wrongdoing but agreed to pay $1 million to settle class members' claims.
