Facts

Everett King was employed by Russ Bassett Corporation. On February 17, 2017, he filed a class action complaint in federal court alleging wage and hour, unfair business practices and Private Attorney General Act penalties. That case was dismissed without prejudice and on June 10, 2019, King filed suit in Los Angeles Superior, representing then-current and former non-exempt employees who worked for Russ Bassett from May 26, 2013 through March 2, 2021.

Contentions

PLAINTIFF’S CONTENTIONS: Plaintiff contended that defendant failed to provide required meal periods; failed to provide authorized and permitted rest periods; failed to pay overtime wages; failed to pay minimum wages; failed to pay all wages due on discharge or termination; failed to timely pay all wages earned; failed to maintain required records; failed to furnish accurate itemized wages statements; failed to reimburse employees for necessary expenditures incurred; and unfair and unlawful business practices.

DEFENDANT’S CONTENTIONS: Defendant denied all allegations and claims, including as to liability, damages, penalties, interest, fees, restitution and other forms of relief.

Settlement Discussions

On May 4, 2018, and all-day session was held with mediator Steve Rottman but the parties did not reach an agreement that day but reached a settlement thereafter.

Result

The case settled for a gross settlement amount of $250,000.
