Facts

Scott Gilmore, James Weeks, Paul Taylor, Sherry Hanna, Amanda Boyette, Julio Ezcurra, Anthony Jewell, and Kristy Williams brought a class action against Monsanto Company. The class included all persons in the United States who, during the class period, purchased certain Monsato Company products in the United Sates other than for resale or distribution.

Contentions

PLAINTIFFS' CONTENTIONS: Plaintiffs contended that defendant falsely advertised and promoted certain Monsato products, including Roundup weed killers, by failing to disclose that the products, and their active ingredient, glyphosate, could potentially cause cancer or other adverse health effects.

DEFENDANT'S CONTENTIONS: Defendant denied all contentions.

Settlement Discussions

The parties engaged in a mediation session before retired United States Magistrate Judge Diane Welsh and ultimately reached an agreement in principle.

Result

The case settled with a range of $23,000,000 to $45,000,000 total. After the claims process was completed and the court ruled on the fees and costs motion, it was determined the total payout by Monsanto, with refunds to class members of an average over $60 each, and the awarded fees and costs, including notice and administration costs, will be $23,000,000.
