Facts

On July 19, 2020, Khalid Barrow, an inmate in San Francisco County Jail, filed a civil rights complaint against the City and County of San Francisco and certain San Bruno Deputies.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff contended that the deputies began to threaten and harass him after his toilet overflowed and he requested a plumber. After plaintiff's request for a plumber, grievance, and cleaning supplies were unheeded, plaintiff began to try to clean the sewage water with his hands, using his bedding to cover the toilet and soak the sewage water. For almost three days, plaintiff had to live with the situation, and as Deputy Lee was in charge and because of the threats, plaintiff was fearful of making any more requests but did speak with the jail's psychiatric services, who when seeing the conditions, forced the morning deputy to have the plumber fix plaintiff's toilet. The situation caused further depression and plaintiff developed rashes. On March 26, 2020, when the doctor came to see plaintiff, the doctor had to request Deputy Mills to step away from listening to plaintiff's conversation with the doctor. Deputy Mills thereafter threatened plaintiff. Some days later, Deputy Mills demanded that plaintiff destroy his Buddhist literature and rip his meditation towel to use as cleaning rags. On April 3, 2020, when plaintiff saw a nurse for his chest pains, with plaintiff handcuffed, Deputy Mills forcibly squeezed his genitals, kissed him on the cheek, and told the other deputies to push plaintiff which caused further injury. His medical needs were ignored for several days. Thereafter, plaintiff asserted that the harassments, threats, violent gestures, and derogatory slurs persisted with the deputies continuing to ignore his requests.

DEFENDANTS' CONTENTIONS: Defendants denied all contentions.

Result

The case settled for $42,500.
