World Gym International IP, LLC is a company that owns gyms across the country and owns the trademark and service mark for WORLD and WORLD GYM as referenced in various U.S. registrations. World Gym International IP, LLC filed a claim against Ia's Fitness LC erroneously sued as Fit World, Chris Anspach, and Semiramis Anspsach, erroneously sued as Ia Anspach, alleging trademark infringement, trademark dilution, unfair competition, and common law trademark infringement.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff alleged that defendant violated their trademarks and service marks for WORLD and WORLD GYM in connection with gym and fitness services in the United States.

DEFENDANT'S CONTENTIONS: Defendant consented to dismissal with prejudice and to the entry of a permanent injunction to prohibit them from using or infringing upon Plaintiff's trademarks and services marks for the WORLD marks in connection with any gym or fitness service.

Result

The court entered judgment in favor of plaintiff.
